Terms of Service
General: Meijerink Advocatuur is a trade name used by multiple lawyers who exclusively practice independently. This includes:
Mr. C. Th. Schouwenburg (Chamber of Commerce number 01141887)
Mr. H.A. Jonker van Dijk (Chamber of Commerce number 01175645)
Mr. H. Meijerink (Chamber of Commerce number 75066408)
(hereinafter: each individually referred to as “the lawyer”)
Schouwenburg Advocaten is not a partnership and not a collaboration in the sense of the Regulation on the Legal Profession. The lawyers operate independently and contract in their personal capacity. The lawyers share the office facilities at Kampstraat 6 in Beilen (9411KS) and operate externally under the name Schouwenburg Advocaten.
These general terms and conditions are stipulated for the benefit of the lawyers and third parties engaged in the execution of the assignment. These general terms and conditions apply to all assignments undertaken by the lawyer within the framework of carrying out legal work for a client.
Liability
The lawyer has liability insurance that meets the requirements set by the Netherlands Bar Association.
Any liability for damages resulting from errors and/or shortcomings made during the execution of services and work by the lawyer and/or those performing services and work on their behalf is limited to the amount paid out in the relevant case by the professional liability insurer.
Engagement of Third Parties
When engaging third parties who are not part of their organization (such as accountants, tax advisors, and medical professionals), the lawyer will exercise due care and consult with the client as much as possible regarding the selection of these third parties. The lawyer is not liable for any shortcomings or damages caused by these third parties.
Fees and Expenses
The costs of executing the assignment by the lawyer include the fee and expenses. Expenses consist of the actual costs incurred by the lawyer on behalf of the client in connection with the assignment (such as administrative fees, court fees, bailiff costs, travel expenses, witness fees, and costs of extracts).
Payment
In principle, services are invoiced to the client on a monthly basis, unless the nature of the service dictates otherwise or a different agreement has been made.
The payment term is 14 days from the invoice date. If payment is not made on time, the lawyer is entitled to charge statutory interest without further notice of default.
The lawyer is entitled to suspend work if payment of an (advance) invoice is not made despite reminders and notices of default.
Third-Party Funds Account
The third-party funds account falls under the Stichting Beheer Derdengelden Schouwenburg Advocaten, registered with the Chamber of Commerce in Meppel under number 04079316.
Conflict of Interest
If the lawyer must withdraw from an assignment due to a conflict of interest, the client will be informed as soon as possible. Due to the confidentiality obligation imposed by the Dutch Lawyers Act, it may not be possible to disclose the nature of the conflict of interest to the client.
Archiving
After the assignment is completed, relevant (legal) documents belonging to the case file, which have not already been returned to the client upon conclusion of the case (whether upon request or not), will be kept at the offices of Schouwenburg Advocaten for at least five years, after which they will be destroyed.
Personal Data & Privacy
Personal data provided to the lawyer, as well as personal data of other involved parties, will be stored in a database. These personal data will be used solely for executing the agreement and based on a legal obligation. The data will always be handled in accordance with legal frameworks, as stipulated in the regulations of the Bar Association.
